This regulatory sandbox aims to identify legal obstacles to implementing projects, such as potential exemptions; liability risks and state aid rules. The sandbox is designed and implemented based on the following steps: choosing the right duration and place for the sandbox; clarifying who is responsible for supervision and evaluation; defining indicators and data sources for evaluation; and making targeted use of the findings. In 2017, the BMWi authorized the testing of an autonomous public transportation vehicle in its sandbox framework, as part of the ‘Autonomer Bus’ project conducted by the Deutsche Bahn in the city of Bad Birnach in Bavaria. The regulatory gaps and uncertainties concerning autonomous driving in the current regulatory framework in Germany have been identified by launching the sandbox. This allows the German automotive industry to further develop and test automated driving functions and continue to be a leader in this sector in the world.
